Please carefully read these terms and conditions (“Terms and Conditions”) before using this licensed mobile application (“Racing GPS”). You are indicating that you agree to the following Terms and Conditions and enter into this Agreement with Hong Kong Cable Television Limited (“CABLE TV”, or “we” or “us” or “the Company”) by using the services under “Racing GPS”. If you do not agree to these Terms and Conditions, please do not access to “Racing GPS”. “Racing GPS” is acquired in whole or in part from materials supplied by “CABLE TV” and/or other sources, is protected by copyright laws, trademark laws and other relevant intellectual property laws. All rights are owned or retained by “CABLE TV” and its subsidiary companies or affiliates or their respective licensors including copyright and in the content of the “Racing GPS”.

Your acceptance of these Terms and Conditions which take effect at the moment you register with and use the “Racing GPS”. “CABLE TV” reserves the right to modify these Terms and Conditions at any time in its sole discretion by posting changes online at https://service.i-cable.com (the “Website”). You agree to be notified of changes to the Terms and Conditions via posting of updates on the Website. You should visit the Website regularly to review the current terms. Your continued use or accessing of the “Racing GPS” following posting of any changes to the Terms and Conditions constitutes your acceptance of such changes.
You are responsible for any data usage costs incurred in accessing “Racing GPS” service via any mobile devices.
Only applicable to subscriber of paid “Racing GPS” service
1. “Racing GPS” service will be suspended automatically upon the expiry of the commitment period. Commitment period is the minimum subscription period applicable to your selected service(s).
2. The fees of “Racing GPS” must be paid in advance. Subscriber needs to make one-off payment upon subscription of services. If you choose to terminate the service for any reason within the commitment period, no service fees will be refunded.
3. If you have registered additional paid services (e.g. PayPer-View or Pay-Per-Event service) before upgrading to monthly or annual service packs which have included the additional paid services you have already registered, your pre-paid additional service fee cannot be refunded no matter you have used those registered additional paid services or not.
Only applicable to free trial “Racing GPS” users
1. If your registered service plan is “Free Trial Plan”, you are entitled to have complimentary use of Racing GPS app – VIP contents from the time you successfully registered for the duration of the free trial period as specified by us. If you subscribed a “30-day Free Trial” service, the free trial period will be expired on the 31st day at 00:00 hour, and you will not be charged for such service thereafter.
2. Free Basic Pack within the free trial period.
3. Purchase of additional “Racing GPS” services is not available within the free trial period.
4. Each mobile number can only enjoy the free trial service once.
Certain content of the “Racing GPS” is only available: (a) to registered users; (b) to selected registered users; and/or (c) upon payment of a fee. Where access to certain content on the “Racing GPS” service is restricted to registered users, you may only access such content by using a login ID (which is your registered telephone number & email address). You may also be required to give a unique account information and password combination in order to access and use the “Racing GPS”. We are not liable for (a) any harm caused or related to the theft or misappropriation of your account information or password; (b) your disclosure of your account information or password or; (c) your authorization of anyone else to use your account information or password. You agree to notify us as soon as you are aware of or believe that there is unauthorized use of your account information. We reserve the right to deny access and use to any user, including without limitation, a registered user, or any services, features or functions of the “Racing GPS” if we believe that the identity of the person trying to access the services, features or functions is doubtful.
CABLE TV may vary the rates charged by giving not less than 30 days’ notice.
You acknowledge that certain channels, programmes and other Content on the “Racing GPS” service are provided by third party providers, not by us. The availability of programmes and other Content on such channels, are out of our control. We make no representation, promise, warranty, undertaking or guarantee as to the quality, completeness, usefulness or continuity of any particular Content. You have not relied upon any information or statement to the effect that any particular Content will be made available to you for the whole or part of the term of your subscription to the “Racing GPS” service. We can vary, replace or withdraw any channels and programs with or without notice to Subscribers (whether advertised or not) on the “Racing GPS” service.
If we fail to obtain, hold, retain or renew any relevant regulatory approvals or if any relevant regulatory approvals are revoked or if it is required by a relevant authority to cease transmission of such CABLE TV service and/or providing access to any Third Party Service (any channels and programs not produced by CABLE TV) , we will give you at least 7 days’ advance notice (to the extent that it is reasonably practicable to do so) to end your service commitment period and unless otherwise specified in the Contract, we will return the prepaid subscription fee (upfront payment less the service period already used (on a monthly basis)) free of any interest, to you within a reasonable time.
If you have registered for any channel containing gamble material, you must ensure that the adult material is not viewed by any person under the age of 18 or by anyone who may be offended by it.
“CABLE TV” shall not be liable for any failure of any services of the “Racing GPS” in whole or in part for your inability to gain access in whole or in part to such services due to the delay or failure of any communication networks or any party providing such access. The services of the “Racing GPS” is subject to these Terms and Conditions and “CABLE TV” assumes no responsibility for the timeliness, deletion, misdelivery or failure of the provision of any services of the “Racing GPS”.
We may deactivate the “Racing GPS” service at any time without notice to carry out system maintenance, upgrading, testing and/or repairs. We may expand, reduce, withdraw and/ or modify any part of the “Racing GPS” service and/or any Content (meaning any content made available or appearing in the “Racing GPS” service and/or on the Website including but not limited to any data, information, images, graphics, video and/or audio content, applications, downloadable files or other multimedia content that can be accessed through or on the “Racing GPS” service), remove, disable and/or suspend transmission or streaming of the “Racing GPS” service or Content which we consider in our sole opinion, breaches any applicable law, regulation or regulatory directive or to be otherwise unacceptable.
The provision of the “Racing GPS” service is contingent upon the service capacity allocated by us (including but not limited to streaming capacity) for the “Racing GPS” service and the reliability and stability of your internet connection or mobile network which is out of our control. We will not be liable to you or any other third parties (including users of the “Racing GPS” service (whether authorized or not) for any failure or delay in accessing the “Racing GPS” service or any part thereof (whether due to the lack of streaming capacity or otherwise) and/or the consequences or effects on your mobile network, internet connection, their speed and/or bandwidth that may be caused by the “Racing GPS” service.
You are not permitted to (a) reproduce, duplicate, copy, sell, resell, modify, copy, reproduce, republish, upload, post, distribute, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way any material from the “Racing GPS” including the code and software for commercial purpose or any other purpose whatsoever without the prior written permission of “CABLE TV”; or (b) upon receiving “CABLE TV’s” written approval, you may only download the material from the “Racing GPS” on any device owned or controlled by you for your own personal and non-commercial use, provided that you keep intact all copyright and other proprietary notices.
You agree to use the “Racing GPS” only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of the “Racing GPS” by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person.
You agree not to restrict or inhibit any other persons from using the “Racing GPS” service, including, without limitation, by means of "hacking" or defacing any portion of the “Racing GPS” service. You agree not to restrict, change, adapt, sublicense, reproduce, distribute, copy, modify, exploit, translate, sell, reverse engineer, decompile or disassemble any portion of the Application, “Racing GPS” service, any of the software and/or any Content. You agree not to remove any copyright, trademark, or other proprietary rights notices contained in the “Racing GPS” service and/or the Content. You agree not to collect information of users of the “Racing GPS” service. You agree not to hack, break into, or attempt to hack or break into, in any manner the “Racing GPS” service, the software, and/or any data areas on our server(s) or that of any third parties. You agree not to interfere with or disrupt the “Racing GPS” service or servers or networks connected to the “Racing GPS” service.
You agree that “CABLE TV” may periodically collect and use technical data and related information, including but not limited to UDID, technical information about your device, system and application software to facilitate the provision of software updates, product support and other services (if any) to you related to the “Racing GPS”.
In no event shall “CABLE TV” or its subsidiary companies or affiliates or their authorized persons be liable to you or any person for any direct, indirect, punitive, incidental, special, consequential damages (including damages relating to lost profits, lost data or loss of goodwill) or any damages whatsoever that result from your use of or inability to use “Racing GPS”. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, and even if “CABLE TV” has been advised of the possibility of such damage. “CABLE TV” or its subsidiary companies or affiliates does/do not warrant that the functions or material contained on the “Racing GPS” will be uninterrupted or error free, that defects will be corrected, or the “Racing GPS” , the software, the device or the server that makes it available are free of viruses or bugs or represent the full functionality, accuracy and reliability of the materials.
Nothing contained herein shall be construed as conferring by implication, estoppels or otherwise any license or right under any trade mark or patent of “CABLE TV” or its subsidiary companies or affiliates or any other and/or third party. Names, images and logos identifying “CABLE TV” or its subsidiary companies or affiliates, or third parties and their products and services are proprietary marks of “CABLE TV” or its subsidiary companies or affiliates and/or third parties.
You agree that “CABLE TV” is free to use, disclose, adopt and modify all and any ideas, concepts, knowhow, proposals, suggestions, comments and other communications and information provided by you to us (“Feedback") in connection with the use of the “Racing GPS” without any payment to you. You hereby agree to waive the rights to claim any payment, fees, royalties and/or any other claims whatsoever in relation to the use of “Feedback” by us.
“CABLE TV” makes no representation about any software, materials, applications, media platforms, devices or services of third parties (such as our advertisers, sponsors or promotional partners) that you may access through, or are linked to or embedded in the “Racing GPS”. “CABLE TV” will not be responsible for the accuracy of the contents. “CABLE TV” does not approve any third party’s software, materials, applications, medial platforms, devices or services and you agree to use any third party’s software, materials, applications, media platforms, devices or services at your own risk. Any transaction or your dealings with any third parties via the “Racing GPS” or linked sites or applications are solely between you and such third parties. “CABLE TV” will not be liable or responsible for any loss or damage whatsoever and howsoever incurred as a result of any such transactions or dealings or arising from the use of the “Racing GPS” and those linked sites or applications.
You agree to indemnify and hold harmless “CABLE TV”, “CABLE TV’s” subsidiary companies, affiliates and their respective licensors, directors, officers, employees and agents from and against all liabilities, actions, claims, proceedings, damages, costs and expenses arising out of or related to (a) your breach or non-observance of any term of this Agreement; (b) your access to the “Racing GPS”; (c) the contents or information you have provided during the access to the “Racing GPS” or personal information you submit, post to or transmit through the “Racing GPS”.
We have adopted the Wirecard Checkout Page for providing secure online payment service. The Wirecard Checkout Page fulfils the PCI DSS security standard of the PCI Standard Council. The information you input via the Wirecard Checkout Page including your name and credit card information is encrypted and could not be read as the above valid information transmits over the internet.
The paid content (including channels & videos) of Racing GPS app will be able to access within 15 minutes after finishing the subscription, successful payment and service activation via internet.
Privacy Policy: You represent that you shall comply with the terms and conditions of our Privacy Policy as set out on (https://service.i-cable.com). The Privacy Policy sets forth and describes our practices with respect to the collection, use and disclosure of personal information in connection with your use of the “Racing GPS” service. “CABLE TV” reserves the right to amend the provisions of its Privacy Policy at its sole discretion. “CABLE TV” will post any changes to its Privacy Policy online and your use of “Racing GPS” service after the posting of such changes will constitute your acceptance of any such changes. If necessary, CABLE TV may transfer your personal data to places outside Hong Kong for carrying out the purposes, or the directly related purposes specified above, for which the personal data was collected. Where such a transfer is performed, it will be done in compliance with the prevailing requirements of the Personal Data (Privacy) Ordinance, Cap 486 of the laws of Hong Kong. Subscriber is entitled to know what personal data the Company may have about Subscriber and to correct any errors. To access or correct any data, please write to the Personal Data Officer, CABLE TV, P.O. Box 357 Tsuen Wan Post Office or pdenquiry@i-cable.com. The Company may impose a modest charge for complying with a data access request.
Disclaimer: The materials on the “Racing GPS” service are provided “AS IS” and on an “IS AVAILABLE” basis without warranty of any kind whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. You understand and agree to use “Racing GPS” service and/or any contents there from at your own risk. “CABLE TV” disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the “Racing GPS” service. You assume full responsibility for (a) your use of the “Racing GPS” service and any linked sites; (b) any contents downloaded or otherwise acquired through the use of the “Racing GPS” service are acquired at your own discretion and risk; and (c) any damage to your device or loss of data that results from the download of such contents. No advice or information, whether oral or written, obtained by you from “CABLE TV” or through the provision of the “Racing GPS” service will create any warranty not stated in these Terms and Conditions.
If any part of these Terms and Conditions shall be deemed unlawful or for any reason unenforceable, then that provision shall not affect the validity and enforceability of any of the remaining provisions of these Terms and Conditions.
No failure or delay by “CABLE TV” in exercising any right, power, privilege or remedy hereunder shall in any way impair or affect the exercise thereof or operate as a waiver thereof in whole or in part, nor shall any single or partial exercise of the same preclude any further exercise thereof or the exercise of any other right, power, privilege or remedy.
The above terms and conditions are governed by and construed in accordance with the laws of Hong Kong and you agree to submit to the exclusive jurisdiction of the courts of Hong Kong.
The Contracts (Rights of Third Parties) Ordinance (Cap.623) shall not apply to this Agreement. For clarity, a person who is not a party to this Agreement shall have no right to enforce this Agreement.
These Terms and Conditions are prepared in English and Chinese. Both the English and Chinese versions shall be of equal legal effect.
